What this policy covers

Welcome to Vizziam. Our Privacy Policy explains how Vizziam Tecnologia Ltda (“Vizziam”, “we” or “us”) collects, uses, discloses, and protects information when you use the Vizz360 app, the Molduras360 website, and the other services of Vizziam (the “Service”) or interact with us, and your choices regarding the collection and use of your information. Capitalized terms that are not defined in this Privacy Policy have the meaning assigned to them in our Terms of Use. If you do not want your information to be processed in accordance with this Privacy Policy in general or any part of it, you should not use our Service.

Summary: Welcome, here is our privacy policy. It defines how Vizziam collects and uses information about you — including the photos and videos you produce in Vizz360 — and explains the choices you can make about how we use your information.

1. Data we collect

We collect the following types of data about you:

(a) Data you provide directly to us

We may request certain information when you register for an account with Vizziam or interact with us (such as username, first and last name, date of birth, physical address, and email address). We also collect all messages you send to us through the Service and may collect information you provide in the User Content that you publish on the Service (such as text and images that you upload to use in your Designs). We use this information to provide and maintain the features of the Service, to communicate with you, and to resolve any issues raised.

If you do not provide us with your personal data, you may not be able to access or use our Service in full.

Summary: We collect data that you provide directly to us, for example, when you register an account, use the Service, or interact with us.

(b) Information we receive from third-party services

We may receive information about you from third parties. For example, if you access the Service through a third-party connection (such as Google), that third party may pass information about your use to us. You should always review your privacy settings on third-party sites before linking them to our Service.

Summary: When you use our Service, if you log in through a third-party application such as Google, we may obtain data about you from that application.

(c) Data we collect automatically and Tracking Technologies

With your consent choice, we may collect or generate pseudonymous information about use of the Service, such as pages visited, source of the visit, campaign, clicks on elements, scrolling, and engagement time. We use a random visitor and session identifier; we do not use hardware fingerprinting for Site Report, do not store raw IP, and do not record passwords, messages, or values entered in forms. Marketing Cookies and Pixels are only activated when you authorize that category.

Summary: With consent, we use pseudonymous browsing data to measure traffic, improve the website, and understand which campaigns generate results. You may continue with necessary cookies only.

(d) Photos and videos you produce (Media)

When you use Vizz360, we collect and temporarily store the photos and videos you capture or generate (“Media”), including versions with overlays (frames), filters, and templates applied, to enable download and online sharing with your clients and guests. Details about the retention period and deletion of this Media are described in Section 6 of this Policy.

(e) Device permissions and data

In order to function properly, Vizz360 may request access to permissions on your device, including camera, storage, Bluetooth, location, and notifications. We explain the purpose of each of them in Sections 8, 9, and 10 of this Policy.

(f) Payment and billing data

When you subscribe to a paid plan, purchase overlays, templates, storage packages, or a custom domain, we collect data necessary to process the charge (such as card data, CPF/CNPJ, and transaction history), through partner payment processors.

2. How we use your data

  • Provision of the Service: We use information about you to provide access, operate, maintain, charge for transactions, and deliver the platform’s features, including the storage and sharing of your Media.
  • Improvement of the Service and Machine Learning (AI): We may analyze your activity, content, media uploads, and related data in your account to train and provide advanced Artificial Intelligence features, as described in our Terms. Such analyses help editing tools (background removal, text suggestions, customized overlays and templates, etc.) evolve.
  • Personalization and Communication: To suggest models that are suitable for you and contact you with essential alerts (such as the expiration deadline for your Media), technical support, news, offers, and satisfaction reports, including by push notification.
  • Advertising: We use tracking information and cookies to serve personalized advertising (through platforms such as Google Ads and Meta Ads) about our plans to you.
  • Security: To prevent, detect, mitigate, or respond to fraud (payments), violations of Terms of Use (including deepfakes/nudity), or threats to network security, including with the support of location data.

Summary: Vizziam uses data about you for different reasons, including operating the media storage service, customizing overlays and templates, and training the integrated Artificial Intelligences to generate increasingly better designs.

3. Sharing your data

(a) Our service providers and infrastructure

We share your information with third-party providers only for logistical purposes of the Service (for example, cloud providers for storage; payment processors for billing; AI platforms to perform actions on your Designs; and, when applicable, domain registrars to enable custom domains). We contractually require them to respect and protect the confidentiality of your files.

(b) Sharing that YOU perform

Any Media or Design that you voluntarily disclose through links, through the sharing functionality, may be accessed by third parties and freely read while the link is active. If you operate using a Team Account under the administration of a company (Administering Entity), we inform you that it has control over the Designs created and emails linked in that corporate group.

(c) Mergers, Acquisitions, and Legal Authorities

Vizziam may transfer your data in due diligence and corporate acquisition of control processes, without prejudice to this policy. The Service undertakes to deliver files of a user who is under investigation as a result of a court order or subpoena, in compliance with the laws of the Federative Republic of Brazil.

Summary: We may share your data with financial billing platforms and cloud providers to keep the Service online. Otherwise, your Media is private until the moment you decide to share the link with someone.

4. Advertising and marketing

We partner with third-party ad networks and social media platforms (such as Google, Meta, and TikTok) to provide personalized ads (“ads”) that may be of interest to you on the internet, or even to identify similar usage interest in similar audiences (lookalike). You may always use browser controls or request an opt-out if you no longer want to see Vizziam campaigns in your digital environment.

5. Purchase of Overlays, Templates, and Custom Domains

When you purchase overlays, video templates, or a custom domain, we collect the data necessary to process the purchase and deliver the Digital Product (purchase history, files used and, in the case of domains, the registration data required by the partner registrar). This data is retained for the period necessary for tax, accounting, and support purposes, as set forth in Section 7 of this Policy.

6. Storage, Retention, and Deletion of Media

Under the plan currently in effect (“Light Plan”), the photos and videos that you send to our servers remain available for 15 (fifteen) calendar days from the upload or generation of each Media. Once this period ends, the Media is automatically and permanently deleted from our servers, without any backup copy maintained by Vizziam, and it is not possible to recover it by any means thereafter.

It is your responsibility to download and back up the Media before the end of this period, as well as to inform your own clients and guests about the availability period. If Vizziam makes paid extended storage plans available (annual packages with a space limit in GB), the 15-day retention period is replaced by the contracted period, and, upon its end or upon exceeding the contracted space, the same automatic and permanent deletion rules described herein shall apply. These retention rules are also described in our Terms of Use.

Summary: Your photos and videos remain on our servers for 15 days and are then deleted forever, without our backup. Download your Media (and notify your clients) before the deadline ends.

7. International transfer, data preservation, and duration

The internet is global. To ensure a fast response in the delivery of Designs, your data is stored in the cloud, mostly through instances located in the United States or in Brazil. We ensure that the infrastructure companies used for the Service adopt adequate security measures against cyberattacks.

After termination of your account, Vizziam will keep essential registration and financial data (such as receipts and invoices) for the period required for tax purposes of 5 (five) years, and operational metadata for investigations or audit for a commercially justified period. This does not apply to the Media itself, which follows the deletion rules in Section 6 of this Policy.

Summary: We store and protect your data with the best cloud providers available, but by registering you understand that data may travel through and remain in datacenters outside your country (North America and Brazil) for the proper operation of the image rendering and AI tools.

8. Push Notifications

With your permission, we send push notifications to your device with information about the status of your Media — including notices that the deletion deadline described in Section 6 is approaching —, as well as news, promotions, and support communications. You may disable notifications at any time in your device or application settings, aware that, by doing so, you may cease to receive important notices about the expiration deadline for your Media.

9. Location and Geolocation

With your permission, we collect location data from your device to associate your Media and events with the place where they occur, enable Service features linked to in-person events, and for security and fraud prevention purposes.

This permission is also required by your device’s own operating system to enable offline sharing of Media. Without location permission granted, it is not possible to share Media in offline mode.

You may deny or revoke this permission at any time in your device settings; in this case, in addition to other features that depend on location, offline sharing of Media may also become unavailable.

10. Device Permissions

In addition to location and notifications, Vizz360 may request:

  • Camera: to capture photos and videos directly in the application.
  • Storage: to save local copies of your Media on the device and to access files that you wish to send to the Service.
  • Bluetooth: to connect the application to event equipment, such as kiosks and compatible external cameras.

These permissions are requested only when necessary for the operation of the respective feature, and you may revoke them at any time in your device settings, with possible limitation of the corresponding functionalities.

11. Your preferences and rights regarding your Personal Data

Under the protection of the Brazilian General Data Protection Law (LGPD, Law No. 13,709/2018), as well as applicable complementary international provisions such as CCPA or GDPR, you have the right to:

  • Move, anonymize, deactivate, export, or request in detail which data we hold about you through our contact email.
  • Access or rectify inaccurate information in your application or account settings;
  • Opt out of Vizziam newsletters and marketing communications from the footer of the messages or from the notification settings.

When Vizziam is instructed by law not to delete an account in which there is an ongoing proceeding for fraud or serious criminal offenses against others, we will deny deletion of the information by legal determination.

Summary: You know what data we have about you. Just send us a request asking for help if you cannot find how to change or remove your account.

12. Changes to this Policy

We may review this Policy periodically to reflect our practices, including the launch of new features such as extended storage, custom domains, or new uses of AI. Whenever there is any update that adds rights or changes the fundamental basis of the Policy, we will send a notice to the email used for login informing you of the new text.
